The Real Estate Law

Real estate is not a term that is used only in a few regions. In fact, this term represents the business globally. In many countries and continents such as the USA, Britain, Australia, Canada, and India and in so many other parts of the world, this is the common term used for the business. The business involves activities such as the development of a site.

You may construct fences along the borders of a marked land and do other conserving activities of the land. This makes the land more saleable. There are certain regulations and laws that are uniquely framed for the smooth functioning of real estates. Conflicts might arise while engaging in bigger transactions like when the land that is bought and sold for business and other purposes. Even in transactions targeted at residential purposes, conflicts might arise.

There are more of laws that regulate the real estate business. They avoid conflict and make the business mutually beneficial for both the buyer and the seller. The Real Estate business in itself has different sub businesses like real property or realty which is considered as the opposite to personal property or personalty. Real Estate means not only the land but also the fixtures of the land like the wells, trees, minerals etc.

Real Estate means both the land and the fixtures of the land but the term realty means only the ownership of the land. Real property is always an immovable property. The real estate law is continental and sometimes differs from country to country. It also differs by the type of business that is done. In real estate, there are different types of businesses and for commercial property and real estate residential housing; the laws are different at least to some extent.

The legal requirement made to occupy a dwelling is called as housing tenure. Housing law also include property occupied by the owner, renting the house to tenants, owning condominiums, independent house renting etc. In the case of condominiums the common property of the utilities such as staircases, elevators, and other facilities are owned commonly by each and everyone. They also come under housing tenure.

Here, the laws cover the property actually owned by the resident or occupant, the common areas, and the other units. Different laws are framed for different types of real estate properties, and hence all of them should be known before owning a property. You should at least know the laws of one that pertains to the kind of property you own!
